Tameka Foster is not happy with the latest pool incident involving her son Usher Raymond V while in the care of her ex-husband Usher.

Foster, 42, reportedly asked for an emergency custody hearing on Tuesay, Aug.6, following the incident involving her five-year-old son being rushed to the intensive care unit on Monday after a pool-related accident.

The celebrity stylist has filed legal documents in Fulton County, Ga., and has demanded custody of her two sons, Usher Raymond V, 5, and Naviyd Ely Raymond, 4. Usher was granted primary custody of the two boys last year following a bitter custody battle. However, after the accident, Foster is claiming that Usher has allowed other unfit people to care for their children, therefore, creating an unsafe environment, according to Us Weekly.

Foster filled the documents just a day after Usher Raymond V was taken to ICU after nearly drowning in the pool at the singer's home.

According to TMZ, the boy's arm had gotten caught in the drain of a pool at his father's home while he was playing with his aunt. The boy dove underwater to retrieve a pool toy but had his arm caught in the process. His aunt, Usher's sister, immediately swam down to help the boy but was not able to do anything. A maid also came to try and help but she screamed for help when she couldn't do anything. Two men that had been working in the house rushed to the scene, dove into the pool and was able to free the boy from the drain.

The boy was given CPR and taken to hospital. Usher, who was not at home at the time of the incident, rushed to home immediately and was in the ambulance with his son when he was taken to hospital.

Monday's incident happened a year after the fatal accident involving Usher's stepson Kile Glover. The Grammy winner's tragically died after being hit in the head by a jet ski at a beach. Glover was taken off life support on July 21, 2012, after suffering a brain injury on July 6, 2012.

Usher, 34, was granted full custody of his two children with Foster, three years after he filed for divorce from her in 2009.
